The European Commission has proposed regulations for the administration of Standards Essential Patents. These regulations will establish a ‘Competence Centre’ at the European Union Intellectual Property Office (EUIPO). This Competence Centre will track and assess SEPs and evaluate “essentiality” of individual patents to the specific standard. The Centre will also work with IP owners to assess and evaluate proposed FRAND royalty rates.
