Trade secrets protection
Towards a European regulation, risks and opportunities

Context: Trade secret protection (technical, commercial, strategic) is a major challenge for European industries. Within the framework of the “Innovation Union” initiative, the European Commission has recently proposed new rules for protection of know-how and trade secrets against illegal procurement, use and disclosure of information.
The following questions will be addressed during this conference:
- What are the main features of trade secrets in an innovative business? How to protect one’s business against misappropriation of confidential information (e.g. confidential studies, tenders, clients, suppliers, innovative ideas, etc.)?
- How far shall we go to protect a trade secret? Is the innocent procurement of confidential information from a third party truly reprehensible?
- Are the current legal instruments adequate in the protection of trade secrets: confidentiality agreements, national laws within the European Union, technical protective measures?
- What is the content of the European Commission proposal? Shall it be supported or improved?
- What is the Industries’ position?
- What sorts of business practices are employed by companies to protect trade secrets?
