Employers often provide or use non-compete clauses or agreements with their key employees and independent contractors. These clauses may be seen to limit an employee’s mobility by restricting their ability to pursue other job opportunities. Various countries within North and South America vary as to how these countries handle such clauses or agreements, the reasonableness of these clauses and the employer's actions, whether a broader effort to promote fair competition and enhance economic opportunities for employees would be better, and whether and to what degree employees have freedom to use their skills and knowledge with new employers after a departure.
