The event (organized by LES Italy) aims to compare different jurisdictions in order to provide a comparative framework on evidence gathering in both patent and trade secret disputes, highlighting the main features and challenges involved. The discussions will address the evidence collection tools available in the major jurisdictions, the related operational risks, and the key strategic considerations, offering a practical overview for multi-jurisdictional litigation.
Following an introduction to the main legal and technical aspects of the Italian “descrizione” proceedings under Article 129 of the Italian Industrial Property Code, the event will compare the evidence collection and preservation systems currently adopted in France, Germany, the United States, and the UPC. A final panel discussion dedicated to cross-border litigation will conclude the event.
The conference will feature leading international practitioners and experts from the legal, patent, and institutional sectors, including representatives of the UPC Advisory Committee and UPC technically qualified judges.
This event will be hybrid - speakers and Italian attendees are to attend in-person with virtual participation available to other LESI members.
